JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Daudpur P.S. Case No. 167/2016, registered for offences punishable under Sections 147, 148, 149, 323, 324 and 302 of the Indian Penal Code.
Allegation against the petitioner is that while the informant and his brother and nephew were going on the tractor, co-accused Baby Devi and Upendra Tiwary ordered to kill the informant and his brother, on which Sunil Tiwary assaulted Chotan Mahto (deceased) by fists and slaps and Manish Tiwary (petitioner), Anish Tiwary, Ranjan Tiwary and Dhananjay Tiwary inflicted knife blow causing several injuries on the person of deceased.
Submission of learned counsel for the petitioner is that no specific allegation is attributed against the petitioner and
Patna High Court Cr.Misc. No.65415 of 2018(3) dt.20-11-2018 2/2 there is general and omnibus allegation of stabbing by the accused persons including the petitioner. One of the co-accused Anish Tiwary has been granted bail by a coordinate bench of this court vide order dated 21.09.2017 passed in Cr. Misc. No. 41367/2017 and furthermore the petitioner is in custody since 03.04.2018.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Daudpur P.S. Case No. 167/2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
