JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 14-10-2015 The petitioner apprehends his arrest in relation to Dumraon(N.B.) P.S. Case No. 318 of 2012.

This Court is surprised in the manner in which the learned Sessions Judge, Buxar, has dealt with this case. He has noted that after full investigation police submitted final form, sending no one for trial. Cognizance was taken by the learned Chief Judicial Magistrate differing with the final report. The allegation is of snatching key of bike, mobile and some money. If in such circumstances, the learned Sessions Judge does not find it to be a fit case for grant of anticipatory bail, then I fail to understand as to in what case he would grant bail. In view of the facts above, it is directed that in the

Patna High Court Cr.Misc. No.45222 of 2015 (2) dt.14-10-2015 2/2 event of arrest or surrender in the court below within four weeks, the above named petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar, in connection with Dumraon(N.B.) P.S. Case No. 318 of 2012, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
