JUSTICE BIRENDRA KUMAR ORAL ORDER 17-03-2021 Heard learned counsel for petitioner Nos.1 and 2 and 4 to 6 and learned Additional Public Prosecutor for the State. Petitioner Nos.1 and 2 and 4 to 6 are apprehending their arrest in a case registered for the offences punishable under Sections 147,149,341,323,324,354,307,379,504,506 of the Indian Penal Code.

Petitioner No.2-Pawan Kumar Mahto allegedly assaulted causing injury at the head of Dhanraj Giri. The Doctor has found fracture of frontal bone of the skull. Since petitioner No.2-Pawan Kumar Mahto had knowledge that his act might cause death, I am not inclined to

Petitioner Nos.1 and 4 to 6 carry general and omnibus allegation. There is case and counter case. Hence, let petitioner Nos.1 and 4 to 6, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Dhuraudha P.S.Case No. 163 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further petitioner Nos.1 and 4 to 6 shall fully cooperate with the investigation/trial of the case and also petitioner Nos.1 and 4 to 6 shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of petitioner Nos.1 and 4 to 6.
