The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30/38 of the Bihar Prohibition and Excise Act, 2016.

It is contended that there is no recovery of any liquor or wine from the conscious possession of the petitioner rather Rs.16,000/- were found in his pocket. It is urged that petitioner has been implicated in this case only on the basis of suspicion. It is further contended that petitioner is involved in two criminal cases lodged by his own uncle under Section 324, 326, 307 etc. of Indian Penal Code due to land dispute in which the petitioner has already been granted bail. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, VI, Samastipur in connection with Kalyanpur P.S. Case No. 73 of 2017. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
