The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. It is a case of recovery of about 126 liters of english wine from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case He further submits that provision of Section 100 of the Cr.P.C. is not followed. Petitioner has got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

After considering the facts and circumstances and fact

Patna High Court CR. MISC. No.52271 of 2021(2) dt.06-04-2022 2/2 that the liquor was recovered from the house of the petitioner as is evident from the seizure list, as such, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.
