The petitioner is languishing in custody since 07.03.2017 in a case for the offence registered under Sections 147, 148, 149, 341, 504, 435, 436 of the IPC, 27 of the Arms Act and 16 U.A. P. Act.
The prosecution story, in brief, is that when the informant was on duty in a Company, one person came and closed the Generator and several criminals of banned organization having with arms came there and shot fire in the camp room of the Company causing damage to vehicles, JCB Machines etc. It has been submitted by learned counsel for the
Patna High Court Cr.Misc. No.42811 of 2017 (2) dt.20-09-2017 2/2 petitioner that the petitioner has falsely been implicated in the present case due to mistake of fact. The charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. General and omnibus allegation has been made against the petitioner. No specific allegation has been made against the petitioner.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M.
