The petitioners apprehend their arrest in connection with Parbatta P.S. Case No. 84 of 2016 pending in the Court of Chief Judicial Magistrate, Khagaria instituted for the offences punishable under Sections 302/34 of the Indian Penal Code. The informant on information went to the Hospital where his son was admitted. The son disclosed that he was called by the accused persons named in the First Information Report including the petitioner and was assaulted mercilessly by lathi and Danda. Thereafter they dragged him to nearby field where also assault was inflicted. Upon seeing the police party, the accused persons escaped. The son of the informant later died in
Patna High Court Cr.Misc. No.29391 of 2016 (2) dt.02-09-2016 the hospital.
On going through the statement made in the bail application as well as the observations made by the learned single Judge in the impugned order, I am of the view that it is not a fit case for grant of anticipatory bail. The prayer for anticipatory bail is rejected.
