02-03-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Raxaul P.S. Case No. 38 of 2019 registered for the offence under Sections 406, 420, 120(B) of the Indian Penal Code.

The allegation against the petitioner is that he alongwith one co-accused Santosh Kumar received an amount of Rs. 3,81,200/- (three lacs eighty one thousand two hundred) from the informant for booking a flat in the year 2014, for which, an agreement was also prepared that within three years after construction of flat, the same will be handed over to the informant, but it is alleged that after expiry of aforesaid time, the flat has not been constructed. Thereafter, the informant sent legal notice to them, but the accused did not receive the same. In view of aforesaid facts & circumstances and materials available in case diary, I am not inclined to extend the privilege of bail.
