JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-03-2021 Heard Mr. Binod Kumar Sinha, learned Counsel for the petitioner and Mr. Nawal Kishore Prasad, learned Additional Public Prosecutor for the State, through Video Conferencing. This application, for grant of regular bail, arises out of Saharsa Sadar (Sonbarsa Kachahari) Police Station Case No. 371 of 2020, disclosing offences under Sections 414, 399, 402, 120(B) of IPC and Section 25(1-b)a, 26, 35 of the Arms Act. The allegation, as per the First Information Report is that police got secret information that some miscreants have assembled in order to commit crime proceeded towards the place of occurrence and upon seeing the police party, 4-5 persons, who were assembled there, started fleeing away, however, two persons were apprehended and from whose

Learned counsel for the petitioner submits that the the name of the petitioner has been disclosed by arrested coaccused and no incriminating material and / or fire arms has been recovered from the possession of the petitioner and petitioner is having no criminal antecedent and he is in custody since 05.05.2020.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that no incriminating material has been recovered from the possession of the petitioner and he is in custody since 05.05.2020 having no criminal antecedent, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, Ramanand Kumar @ Ramanand Sharma @ Ranjit Sharma @ Raja, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar (Sonbarsa Kachahari) Police Station Case No. 371 of 2020.
