The petitioner apprehends her arrest in Ranitalab P.S. Case No. 04 of 2016 registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.
The informant alleged that his daughter was married with Biteshwar Paswan on 25.05.2015, but her husband and other in-laws were torturing her due to non-fulfillment of demand of dowry. The informant got information that on 05.01.2016 the accused persons strangulated her daughter to death. Learned counsel for the petitioner submits that the petitioner is mother-in-law of the deceased. Lalsa Kumari the daughter of the petitioner was hospitalized and the petitioner was
Patna High Court Cr.Misc. No.30214 of 2016 (3) dt.19-10-2016 2/2 attending her. The petitioner was not even present in her house on the date of occurrence. The deceased committed suicide by hanging herself as she had quarrel with her husband. None of the witnesses have stated in the case diary about demand of dowry and torture.
Considering the facts aforesaid and the fact that the petitioner is mother-in-law of the deceased and no specific allegation is made against her, the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Danapur in Ranitalab P.S. Case No. 04 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
