JUSTICE SANDEEP KUMAR ORAL ORDER 26-10-2021 Heard learned Senior Counsel for the petitioners and learned Additional Public Prosecutor for the State. Learned Senior Counsel prays to withdraw the present application on behalf of petitioners No. 1 and 2 since they have been arrested.

The prayer is allowed.

The application is dismissed as withdrawn as against petitioners No. 1 and 2.

The petitioner apprehend his arrest in connection with Naurangia P.S. Case No. 30/2020 registered for the offences punishable under Sections 341/323/324/307/379/ 506/34 of the Indian Penal Code.

Patna High Court CR. MISC. No.38792 of 2020(3) dt.26-10-2021 2/2 As per the prosecution case, both the sides have sustained injuries on account of a free fight arose because of a petty dispute. There is case and counter case between the parties.

Learned Senior counsel for the petitioner submits that the allegation against the Dharmendra Gond is of assaulting Lalti Devi who has sustained simple injury.

However, learned counsel appearing on behalf of the Informant vehemently opposed the prayer for anticipatory bail. In these circumstances, the petitioner is granted anticipatory bail.

Let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 5th, Bagaha, West Champaran, in connection with Naurangia P.S. Case No. 30/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
