The petitioner apprehends his arrest in connection with Mirganj P.S. Case No. 256 of 2015 registered under Sections 341, 323, 307, 498A, 406/34 of the I.P.C. and 3⁄4 Dowry Prohibition Act pending in the Court of C.J.M., Gopalganj. Learned counsel appearing on behalf of the petitioner submits that petitioner, who happens to be husband of the deceased, daughter of the complainant, has falsely been implicated in this case. The allegation of demand of dowry is false and baseless.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission

Patna High Court Cr.Misc. No.28306 of 2016 (10) dt.06-04-2017 2/2 that there is specific allegation of torture and cruelty against the petitioner.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
