The petitioner seeks regular bail in connection with Jandaha PS case no. 153 of 2018 registered for the offence punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016.

The allegation of the prosecution is that 765 litres of illicit liquor was recovered from the poultry farm of one Santosh Kumar Singh and the petitioner was apprehended from the said poultry farm while he was arranging the cartoons of illicit liquor.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and the poultry farm also does not belong to the petitioner

Patna High Court Cr.Misc. No.52931 of 2018(3) dt.12-12-2018 2/2 herein. The petitioner is stated to be having a clean antecedent and is languishing in custody since 02.07.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge-II-cum-Special Judge, Vaishali at Hajipur in connection with Jandaha PS case no. 153 of 2018.
