The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 of the Indian Penal Code and Section 7 of the E.C. Act. It is a case of recovery of two bags of rice and one bag wheat from the two motorcycles.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that nothing has been recovered from the possession of the petitioner and on the confessional statement of co-accused, the name of the petitioner came into light and no incriminating articles relating to PDS were recovered and seized. Petitioner has got clean antecedent.

Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnia in connection with Angarh P.S.
