The petitioner has prayed for bail in a case registered for the offence punishable under sections 382 and 414 of the IPC and Section 22(b) of the NDPS Act.

As per allegation in the FIR, on getting secret information police party proceeded towards place of occurrence, and apprehended two accused persons including the petitioner. On search, 1tazowin injection (5 ps X 1ml ), empty strip of Anrcit tablet , one blade, one screw driver and 3 whitner were recovered from possession of the petitioner.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

Patna High Court CR. MISC. No.44956 of 2023(2) dt.28-07-2023 2/2 offence. The seized injections is a pain killer injection and as per advised by doctor, petitioner has purchased it for family member. He has been falsely implicated in this Case. The alleged items does not come within the purview of NDPS Act. Petitioner is languishing in judicial custody since 5.4.2023. Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Jduge, Darbhanga in connection with Laheriasarai PS Case No. 160 of 2023.
