Petitioner prays for bail in connection with Naya Ram Nagar P.S.Case No. 48 of 2018 registered for the offences punishable under Sections 364, 379/34 of the Indian Penal Code and later on Sections 302, 201 and 411 IPC were added. Allegation against the accused persons is of taking away of truck along with Khalasi, who was sleeping in the truck, of the informant and later on dead body of Khalasi was recovered and petitioner is not named in the FIR and it appears that he has made confession before police.
Submission of learned counsel for the petitioner is that except confession before police there is nothing against him and he has no criminal antecedent and he is in custody since 4.3.2018
Patna High Court Cr.Misc. No.52325 of 2018 (3) dt.26-10-2018 2/2 and charge sheet has already been submitted.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Munger, in connection with Naya Ram Nagar P.S.Case No. 48 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
