The petitioner seeks bail in Barhara P.S. Case No. 66/2017, registered for the offence punishable under Section 392 of the Indian Penal Code.
The case of the prosecution is that the informant along with his friend were coming to their house from Purnea by motorcycle and when they reached near Bharna Bridge, then four miscreants on two motorcycles overtook them, surrounded their motorcycle and on pistol point looted the motorcycle, cash etc. Learned counsel for the petitioner submits that the petitioner is innocent, he is not F.I.R. named accused, no recovery has been made. Learned counsel for the petitioner further submits that the petitioner has been falsely implicated in this case and he is in custody since 23.04.2017.
Patna High Court Cr.Misc. No.39380 of 2017 (2) dt.19-08-2017 2/2 Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail immediately upon completion of six months in custody.
Accordingly, it is directed that the petitioner may be released on regular bail upon completion of six months from 23.04.2017, upon such conditions as may be imposed by the learned trial court.
The petition is disposed of.
