JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2019 This is an application for grant of anticipatory bail in connection with Trial No. 2270 of 2019, arising out of Complaint Case No. 2198 of 2018, disclosing offences under Section 498A of IPC and Section 3⁄4 of Dowry Prohibition Act. Allegation against the petitioner, who happens to be the husband of the complainant of subjecting her to cruelty and harassment with respect to demand.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted. He is still ready to keep her with dignity and care. Further, submission is that petitioner has got her treated at Central Institute of Psychiatry, Ranchi, as she has some mental disease.

No.42654 of 2019(3) dt.12-09-2019 2/2 of the complainant, who has submitted that as a matter of fact, the petitioner has taken away the complainant and she is still traceless, for which, he has also filed a criminal case, which will appear from Annexure 3 and moreover, there is allegation of demand and torture also.

Having heard both sides, in view of the allegations made above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.
