JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with S. Trial No. 197 of 2020 arising out of Gurua P.S. Case No. 25 of 2003 for the offence under Sections 307, 323, 341, 147, 148, 149 of the Indian Penal Code and Section 27 of the Arms Act. Earlier petitioner's prayer for bail was rejected by a Bench of this Court vide order dated 04.06.2020 passed in Cr. Misc. No. 73701 of 2019. The Court while reecting the prayer for bail granted liberty to the petitioner to renew his prayer after framing of charge.

Mr. Krishna Prasad Singh, learned senior counsel appearing on behalf of the petitioner, has drawn the attention of

Patna High Court CR. MISC. No.38842 of 2020(2) dt.10-02-2021 2/2 the Court that charge has been framed in this case on 01.10.2020. Petitioner is in custody since 13.08.2019. Considering the fact that the charge has already been framed on 01.10.2020, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 1st, Gaya in connection with S. Trial No.197 of 2020 arising out of Gurua P.S. Case No. 25 of 2003.
