30-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Banmankhi P.S. Case No. 203 of 2019, registered for the offence under Sections 379, 411/34 of the Indian Penal Code.

It is submitted on behalf of petitioner that petitioner is not named in the FIR. Name of the petitioner has transpired in statement of co-accused Binod Kumar Sharma, whose confessional statement was recorded in Janki Nagar P.S. Case No. 135 of 2019. The stolen article has not been recovered from the possession of petitioner. Similarly situated co-accused Ravi Kumar has already been granted bail by this Court, vide order dated 26.08.2020 passed in Cr.Misc. No. 22519 of 2020 (Annexure 2). Petitioner is in custody since 14.10.2019.

Patna High Court CR. MISC. No.52504 of 2021(2) dt.30-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia in connection with Banmankhi P.S. Case No. 203 of 2019.
