2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 324(4), 109(1), 303(2), 74, 352, 351(2) and 3(5) of the B.N.S.

3. As per prosecution case, this petitioner is alleged to have assaulted on the forehead of informant with sword due to which he sustained cut injury on his forehead.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Doctor has found the injuries, sustained by the injured, simple in nature. Petitioner has got no criminal

Patna High Court CR. MISC. No.40668 of 2025(2) dt.08-08-2025 2/2 antecedents and he is in custody since 25.03.2025. Moreover, charge-sheet has already been submitted.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, nature of injuries sustained by the injured, period of custody and clean antecedents of the petitioner, the prayer for grant of bail to the petitioner is allowed.

Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Raxaul at Motihari, East Champaran in connection with Darpa P.S.
