The petitioner seeks bail in Khaira P.S. Case No.40 of 2017 for the offence under Section 25 (1-b) of the Arms Act, Section 3⁄4 of Explosive Substance Act and Sections 10, 13 and 16 of the U.P.A. Act.

Allegation against the petitioner is of recovery of one country made rifle, two neojal strick, two electric detonator at the instance of the petitioner.

Submission of the petitioner is that nothing has been recovered from the possession of the petitioner. He is in custody for six months.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.39181 of 2017 (2) dt.21-08-2017 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner. Prayer for bail of the petitioner is rejected. However, petitioner will be at liberty to renew his prayer for bail after framing of charge.

With the aforesaid observation this application is dismissed.
