This application is for grant of regular bail in onnection with Telhara P.S.Case No.70 of 2017, registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of kidnapping the victim girl.
Submission of the learned counsel for the petitioner is that in her statement under Section 161 Cr.P.C., she has not named this petitioner, however, in her statement under Section 164 Cr.P.C., she has named this petitioner and other accused persons also. Now the petitioner is in custody 23.5.2017.
Patna High Court Cr.Misc. No.41524 of 2017 (2) dt.07-09-2017 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the commitment of the case and once the charges are framed in this case, the petitioner may be released on bail in connection with Telhara P.S.Case No,.70 of 2017 to the satisfaction of A.C.J.M., Hilsa.
With the aforesaid observation, this application is disposed of.
