Petitioner apprehends his arrest in connection with Didarganj P.S.Case No. 80 of 2017 registered for the offences punishable under Sections 328, 304B, 34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

Allegation against the petitioner, who happens to be husband of the deceased, is of causing death of the deceased. Submission of learned counsel for the petitioner is that he himself informed the informant about her condition become serious and taken her to the hospital for treatment and there she died and thereafter the petitioner has falsely been implicated in this case.

Heard learned APP also. From perusal of the report at

Patna High Court Cr.Misc. No.11501 of 2018 (5) dt.13-08-2018 2/2 Flag 'X' it appears that viscera has not been sent for examination. Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Anant Kumar, Judicial Magistrate, Patna City, Patna, in connection with Didarganj P.S.Case No. 80 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
