Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Chakand PS case no. 54 of 2019, disclosing offences punishable under Sections 341, 323, 435, 379, 504, 506/34 of the Indian Penal Code.

From perusal of the impugned order dated 13.05.2024, passed by the learned court of Additional District and Sessions Judge -I, Gaya, it appears that bail application of the petitioner has not been rejected. The bail application filed by the petitioner has been disposed with a direction to the Police that if the Police needs to arrest the petitioner, 15 days' prior notice would be served upon him. Accordingly, there is no apprehension of arrest to the petitioner.

Considering the aforesaid facts and circumstances, I find that the present bail application is not maintainable, as such, the same is rejected, however liberty is granted to the petitioner to move for anticipatory bail before the Sessions Judge, Gaya, if he receives notice from the Police.
