The petitioner apprehends his arrest in Motihari Town P.S. Case No. 135/2015/G.R. Case No. 869/2015, registered for the offences punishable under Section 414 of the Indian Penal Code 25(1-b)a, 26, Section 35 of Arms Act.

The petitioner is not named in the F.I.R. The police raided the place and apprehended Mukesh Kumar and two others. The petitioner is one of the accompaniers who had knowledge about the occurrence, took place on 16.02.2015 in R.K. Jewellers, Gyan Babu Chowk.

It is submitted that save and except the disclosure made by the co-accused there is no material to show the involvement of

Patna High Court Cr.Misc. No.44683 of 2015 (3) dt.21-12-2015 2/2 the petitioner, but it appears that he has got criminal antecedent and he is accused in two other cases registered under Section 392 and other Sections of the I.P.C.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
