ANJANA MISHRA ORAL ORDER 11-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Ghanshyampur P.S. Case No.22 of 2015 for allegedly having committed the offence under Sections 414, 467, 468, 471, 420/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but subsequently on the basis of the confessional statement made before the police by one Bolbam Sharma, who was arrested in connection with another case, that the petitioner's name has been drawn in connection with the present case.

Having heard learned counsel for the petitioner and

No.32147 of 2016 (3) dt.11-11-2016 2/2 the learned counsel for the State and considering the fact that confessional statement made before the police has no evidentiary value and also because the petitioner has another criminal antecedent made by the same person in other case i.e., Ghanshyampur P.S. Case No.4 of 2015, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Biraul, Darbhanga, in connection with Ghanshyampur P.S. Case No.22 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
