The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 354, 353, 337, 504 of the Indian Penal Code.

The prosecution case is that the mob of about 200 people entered into the parade ground of Aurangabad Police Line, when they threw bricks and stones, causing injury to the police constables. The mob also misbehaved with newly recruited lady constables. The name of the petitioner sprang up during investigation as the First Information Report was lodged against three named along with seventy five motorcyclists and 114 unknown. It is

Patna High Court Cr.Misc. No.35713 of 2016 (2) dt.02-09-2016 also alleged that the petitioner's motorcycle was found parked near the parade ground.

It is submitted by the learned counsel for the petitioner that since the motorcycle of the petitioner was found parked near the parade ground hence on suspicion he has been roped in the present case. The petitioner parked the motorcycle for doing morning walk near parade ground in the meantime occurrence took place. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. It is further submitted that coaccused person has been granted bail vide Cr. Misc. No. 7141 of 2016.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (T) P.S. Case No. 511 of 2015, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
