The petitioner being the Registration Clerk in the Sub Registrar Office at Chapra is apprehending his arrest in connection with Chapra Town P.S. Case No. 282 of 2015 registered for the offences punishable under Sections 120(B), 420, 467, 468 and 471/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the present petitioner performed his duty on the basis of the identifications made by the identifier to the executor of the deeds and not otherwise.
In view of the fact that the petitioner was
Patna High Court Cr.Misc. No.32479 of 2016 (2) dt.19-12-2016 2/2 functioning in the office of the Sub Registrar and had been performing his duties even after the date of occurrence and the petitioner has now superannuated from his service and there is no scope of the petitioner of tampering with any evidence, and as submitted, the petitioner is ready at all possible times to cooperate in the investigation and trial, which shall ensue thereafter, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Saran, Chapra in connection with Chapra Town P.S. Case No. 282 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjana Mishra, J) ajaypd./- U T
