JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Bakhri P. S. Case No. 115 of 2016 instituted for the offences under sections 302, 201 and 34 of the Indian Penal Code.

It has been submitted that the petitioner is brother-inlaw of the deceased. As per allegation in the written report son of informant Bhagdeo Mahto went to Sasural for Bidagari of his wife but on the next day it came to his knowledge that a quarrel took place between his son and the family member of Sasural and due to that reason the family member of Sasural administered poison and disappeared his dead body.

Patna High Court Cr.Misc. No.35462 of 2017 (2) dt.02-08-2017 2/2 From the order of the learned Sessions Judge, Begusarai, it appears that there is no specific allegation of overt act against the petitioner.

The petitioner is in jail since 15.06.2017.

In the facts and circumstance of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Begusarai in connection with Bakhri P. S. Case No. 115 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
