14-10-2015 Heard learned counsel for the petitioner and Sri Umanath Mishra, learned Addl. Public Prosecutor. The petitioner, who is already on police bail, has approached this Court for grant of anticipatory bail. In view of provision contained in Section 438 of the Cr.P.C., unless there is apprehension of arrest, one may not make a prayer for anticipatory bail.

Accordingly, I do not find any ground to pass any positive order.

The petition stands disposed of.
