ANJANA MISHRA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Amour P.S. Case No. 54 of 2016 registered for the offences punishable under Sections 147, 323, 324, 307, 379/504 of the Indian Penal Code.
Learned senior counsel appearing on behalf of the petitioner submits that there is a case and counter case between the parties. The occurrence had taken place at a polling booth where they were contesting parties. It is further submitted that the injury as purported to have been inflicted by the petitioner has been found to be simple in nature. Further more another similarly situated coaccused has been extended the privilege of anticipatory bail in Cr.
Patna High Court Cr.Misc. No.29793 of 2016 (2) dt.01-09-2016 Misc. No. 32209 of 2016 vide order dated 26.08.2016. In view of the aforementioned facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Amour P.S. Case No. 54 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J.) ravi/- U T
