The petitioner seeks bail in a case registered for offences under Sections 272, 273 and 414 of the Indian Penal Code and Sections 30 (a) and 47 of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, huge quantity of foreign liquor were allegedly recovered from the truck while it was being unloaded to a pick up vans and several other vehicles from where the petitioner was apprehended by the police on chase. However, it is further contended that the
Patna High Court Cr.Misc. No.40406 of 2017(2) dt.25-08-2017 2/2 petitioner is made accused in one other case, i.e., Varishnagar (Madhurapur O.P.) P.S. Case No. 37 of 2017 for offences under Sections 30(a), 37(k), 37(gh) and 38/41 of the Bihar Prohibition and Excise Act. It is urged that the petitioner is in custody since 17.05.2017.
Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-VIcum-Special Judge, Excise Act, Samastipur in connection with Ujiyarpur P.S. Case No. 82 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
