Petitioner is in custody in connection with Bihra P.S. Case No. 142 of 2019 for the offence under sections 414 of the Indian Penal Code and Section 25(1-b)a 26, 35 of the Arms Act. Learned counsel appearing on behalf of the petitioner would submit that due to criminal antecedent, the petitioner has been made accused in this case.

It is alleged that the name of the petitioner was disclosed by co-accused.

The petitioner is in custody since 7.11.2019. Considering the period of custody, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.38742 of 2020(2) dt.08-02-2021 2/2 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bihra P.S. Case No. 142 of 2019 subject to the condition that the petitioner shall deposit Rs. 50,000/- cash in the court below and the amount of Rs.50,000/- cash deposited by the petitioner shall abide by final outcome of the pending criminal case.
