This application is for grant of regular bail in connection with Forbesganj P.S.cae No.537 of 2017 for the offences under Section 379 of the Indian Penal Code and later on Section 411 of the IPC was added..

Allegation against the petitioner is about recovery of a motorcycle from the Idgah Chowk at the instance of the petitioner.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and one after another the cases have been lodged. The petitioner is in custody since 28.7.2017.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.53207 of 2018 (3) dt.09-10-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, once the charge is framed and the trial commenced, the petitioner shall be released on bail by the learned court below in connection with Forbesganj P.S.Case no.537 of 2017 with condition that he will co-operate in the disposal of the trial.

With the aforesaid observation, this application is disposed of.
