JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Gandhi Maidan P.S. Case No. 287 of 2017 registered under Section 392 of the Indian Penal Code.

The petitioner and other co-accused are said to have snatched the mobile of the informant and on chase said mobile along with two others mobiles and motorcycle were recovered from their possession.

It is submitted by learned counsel for the petitioner that the two mobiles which were recovered from the possession of the petitioner and another accused Satyajeet Kumar were hailing

Patna High Court Cr.Misc. No.46156 of 2017 (2) dt.21-09-2017 2/2 to them. Motorcycle was of the landlord of the petitioner who has given him to ply the same. So far as the mobile of the informant is concerned, it was not recovered from his possession and moreover, the police without seizing the same handed it over to the informant. Similarly situated co-accused Satyajeet Kumar has been enlarged on bail by a co-ordinate bench of this court vide order dated 06.09.2017 passed in Cr. Misc. No. 40691 of 2017. The petitioner has been languishing in custody since 26.05.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-VI-cumACJM, Patna in connection with Gandhi Maidan P.S. Case No. 287 of 2017.
