JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Parbatta P.S. Case No. 34 of 2020 for the offence under Sections 147, 148, 149, 307, 323, 342, 379 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent.

Learned counsel appearing on behalf of the petitioner submits that the occurrence took place at the shop of the petitioner. He further submits that informant's side are aggressor and if the petitioner has assaulted the informant it is justified in his right of private defence for protection of his property. He next submits that in the present case there is general and omnibus allegation

Considering facts and circumstances of the case, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bhagalpur in connection with Parbatta P.S. Case No. 34 of 2020.
