The petitioner, who is lady, seeks bail in Hussainganj P.S. Case No. 53 of 2021, registered for the offence under Section 302/34 of the Indian Penal Code.

As per the F.I.R., this petitioner called son of informant to her house as they had love affairs and thereafter, during search, son of the informant was found in unconscious condition having injury on his head and while being taken to hospital, he was declared dead.

It is submitted on behalf of petitioner that only on suspicion, petitioner has been made accused. Nobody has seen the occurrence. In fact, the deceased had love affairs with another woman and petitioner could not have any motive to commit the crime. Moreover, no blood was found by the I.O. in the room of this petitioner. Petitioner is lady and pattidar of the informant. She is in custody since 23.03.2021.

Patna High Court CR. MISC. No.51959 of 2021(3) dt.20-01-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-9, Siwan in connection with Hussainganj P.S.
