JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 30-01-2016 Every employee is supposed to know as to when he is supposed to retire or superannuate. The plea of the petitioner, who happens to be a Choukidar, that he was not aware and he continued to work on the basis of command issued does not satisfy this Court. Obviously, the things have been manipulated by the petitioner to claim an illegal benefit of salary when he was not supposed to be in service any longer after 31.12.2008.
In view of the same, Annexure- 3 is not interfered with. However, the Court directs that the recovered amount, which has been indicated in Annexure- 3, will be deposited in Bihar Chief Minister's
Patna High Court CWJC No.3242 of 2014 dt.30-01-2016 2/2 Relief Fund where the money can be utilized for the benefit of people in distress.
Writ is dismissed.
