JUSTICE RAVI RANJAN ORAL ORDER 24-11-2015 Heard learned counsel for the petitioner and the State. It appears that on 3.11.2015 time was granted to the State for filing counter affidavit, but no counter affidavit has been filed as yet.

In the facts and circumstances, this writ application is being disposed of without waiting further for filing of the counter affidavit.

Grievance of the petitioner is that his application for renewal of licence no. 3/1993 was filed in the year 2007 with effect from 2005 but no final decision has been taken by the authorities. In the meantime, a show-cause notice dated 10.07.2013 has been issued to the petitioner by the licensing

Patna High Court CWJC No.16710 of 2015 (3) dt.24-11-2015 authority as to why his licence should not be cancelled in view of the fact that he has not renewed it since 2005. The petitioner claims to have filed a reply thereof along with an affidavit, however, it is contended that no final decision has been taken as yet by the authorities.

Learned counsel for the State submits, on instruction, that a second show-cause has also been issued for cancellation of arms licence of the petitioner in view of the fact that he has been found to have been involved in several criminal cases. Be that as it may, this writ application is being disposed of with a direction to the licensing authority to take a final decision in the matter in accordance with law within a period of two months from the date of receipt/production of a copy of this order.
