JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 The petitioner seeks regular bail in connection with Mahkar P.S. Case No. 63/17, registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code. Petitioner happens to be father in law and allegation against him and others is of setting the deceased on fire causing her death.
It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petition and in fact the deceased caught fire while preparing food and information of the occurrence was given to the informant and his family members on 21.04.2017 but they came on 24.04.2017 and the deceased died during course of her treatment on 29.04.2017 and, thereafter, the case was
Patna High Court Cr.Misc. No.53248 of 2018(4) dt.05-11-2018 2/2 registered. Further submission is that petitioner has been in judicial custody since 21.04.2018.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IX, Gaya, in connection with Mahkar P.S. Case No. 63/17, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
