JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-08-2021 Heard Mr. Shambhu Sharan Singh, the learned Advocate for the petitioners and the learned APP for the State. The learned Advocate for the petitioners seeks permission to withdraw the application with respect to petitioner nos.3 and 4 who have been arrested.
The application with respect to petitioner nos.3 and 4 is dismissed as having become infructuous.
The petitioner nos.1 and 2 who are mother-in-law and brother-in-law of the informant respectively seek bail in
Patna High Court CR. MISC. No.1743 of 2021(2) dt.12-08-2021 2/3 anticipation of their arrest in connection with Mahila P. S. Case No.20 of 2020, instituted for the offences under Sections 498(A)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The accusation in the F.I.R. is absolutely vague. Only because the informant has not been lead a happy married life with her husband (son of the petitioner no.1) that this case has been filed, implicating all the family members. The son of petitioner no.1 is separate in mess and business and the petitioners do not have any control over the affairs of the family of the informant and her spouse.
It has also been urged on behalf of the petitioners as far as their knowledge goes, the husband of the informant is also ready to settle the dispute with his wife. Considering the afore-noted arguments on behalf of the petitioner nos.1 and 2, they are, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Banka in connection with Mahila P. S. Case No.20 of 2020, subject to the conditions laid
