The petitioners apprehend their arrest in connection with Hathua P.S. Case No.98 of 2021 registered for offences under Sections 376, 341, 323, 504 and 506 of the Indian Penal Code.
At the very outset, learned counsel for the petitioners submits that petitioner nos. 1 and 3, namely, Kamal Kuresi and Nasib Kursi @ Nasim Kuresi have been arrested during the pendency of this application. Hence, he prays for withdrawal of the application.
Patna High Court CR. MISC. No.56868 of 2021(2) dt.24-05-2022 2/2 Prayer is allowed. The application for anticipatory bail is dismissed as withdrawn so far as petitioner nos. 1 and 3, namely, Kamal Kuresi and Nasib Kursi @ Nasim Kuresi are concerned.
So far as petitioner no.2, namely, Kamrul Kuresi @ Amir Husain Kureshi is concerned, he is related to the main accused Jamal Kuresi.
Considering the aforesaid fact, this application on behalf of petitioner no.2, namely, Kamrul Kuresi @ Amir Husain Kureshi is allowed.
Accordingly, let petitioner no.2, namely, Kamrul Kuresi @ Amir Husain Kureshi, in the event of his arrest or surrender within eight weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Gopalganj in connection with Hathua P.S. Case No.98 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sandeep Kumar, J) BT/- U T
