On getting confidential information regarding assemblage of antisocial element including that of petitioner who has got criminal antecedent, raid was conducted and during course thereof, nine persons were apprehended. On search, from their possession the arms and ammunitions along with other articles were seized as per seizure list.
It has been submitted that petitioner has been falsely implicated and the same is evident from the fardbeyan itself whereunder it has been incorporated with regard to the presence of petitioner since before. Furthermore, simply recovery of a firearm without cartridge has been shown to be from the possession of the petitioner only to justify his detention since 24.12.2015.
Patna High Court Cr.Misc. No.29194 of 2016 (2) dt.25-07-2016 2/2 Learned counsel for the petitioner fairly concedes with regard to the criminal antecedent but also submitted that on account of high-handedness of the police, petitioner is being implicated.
The learned Additional Public Prosecutor opposed the prayer for bail.
In the aforesaid facts and circumstances of the case, petitioner Pulkit Rishi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-1st, Purnea in connection with Sessions Trial No. 163 of 2016 arising out of K.
