JUSTICE SUDHIR SINGH ORAL ORDER 18-09-2018 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner is languishing in custody since 21.10.2016 in a case for the offence registered under Sections 302, 120(B)/34 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that the petitioner alongwith other co-accused persons surrounded the husband of the informant Ram Chandra Jha and all started firing at him causing grievous injury to him. Thereafter, when he was taken to P.M.C.H., he was declared 'brought dead'. They also looted Rs.50,000/- from the deceased.

This is second attempt on behalf of the petitioner for

Patna High Court Cr.Misc. No.50040 of 2018 (3) dt.18-09-2018 2/2 grant of bail.

Earlier the bail application of the petitioner was rejected by the then Co-ordinate Bench of this Court vide Cr. Misc. No. 36508 of 2017 order dated 09.04.2018 taking into consideration that the petitioner has also fired in course of occurrence causing injury upon the deceased. There are as many as six wound of entry were found on the body of deceased. I find no fresh ground for reconsideration of bail of the petitioner. The same is rejected in connection with Beur P.S. Case No. 241 of 2016, pending in the court of learned Additional Sessions Judge-IIIrd, Patna, in Sessions Trial No. 133 of 2017.
