The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, in the fight between the parties, the petitioner is said to have assaulted Ramnevas Sah with a sword on his leg.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations against the petitioner are false and concocted. Even accepting the allegations for the sake of argument, the injury has been found to be simple in nature. The petitioner is in custody since 10.5.2021 and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegations together with the contents of the injury report of Ramnevas Sah which has been found to be simple in nature and the petitioner having remained in custody for over 10 months, the Court directs the petitioner to be enlarged on bail in connection with Bajpatti P.S. Case no. 118 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi.
