2. The petitioner seeks bail in connection with S.Tr. No. 298 of 2025 arising out of Sikta P.S. Case No. 12 of 2025 instituted for the offences under Sections 191(2), 190, 126(2), 115(2), 109, 118(1), 303(2), 352, 351(2) of the Bharatiya Nyaya Sanhita, 2023.
3. Prosecution case, in short, is that accused persons including the petitioner assaulted the informant and his cousin and also looted Rs. 20,000/- from their shop.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. Learned counsel referring to paragraph no. 8 of the present bail
Patna High Court CR. MISC. No.47131 of 2025(2) dt.30-07-2025 2/2 application submitted that the allegation of assault against the petitioner is that he gave knife blow to the stomach of the cousin of the informant but the injury report does not corroborate the prosecution version. Learned counsel further submitted that charge-sheet has been submitted against the petitioner and cognizance has also been taken by the learned court below. It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.02.2025 and has no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with S.Tr.
