The petitioners are apprehending their arrest in a case registered under Sections 304B and 34 of the Indian Penal Code. Petitioners are husband and other relations of husband of Mamta Kumari, who died unnatural death by sustaining burn injury in her matrimonial house within two years of her marriage. There is allegation of demand of dowry and torture for the same. The case diary would reveal that some of the witnesses have supported the demand of dowry. The doctor has found burn injury on the victim.
Submission of the petitioners is that some other witnesses have stated that due to personal dispute between husband and wife the victim might have committed suicide. Further, submission is that the parties have entered into a compromise.
Considering the nature of allegation and burden on the petitioners to prove their innocence, I am not inclined to large them on anticipatory bail.
The prayer for anticipatory bail is refused.
