JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-10-2017 The petitioner seeks regular bail in connection with Excise Case No. 1331 of 2017, arising out of Durgawati P.S. Case No. 160 of 2017, registered for offences punishable under Sections 30(a), 389i)(ii)/41(1)(2)/47 of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 147.96 litres of foreign liquor.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only on the basis of suspicion and nothing has been recovered from his possession rather his name has been disclosed by the co-accused of this case and so far other one case is concerned, in that case also he has falsely been made accused and he has been in judicial custody

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and also the fact that petitioner is named in the F.I.R and he an accused in one more case of similar nature, as such, this application is disposed of with the direction to the court below to expedite the trial and try to conclude within a period of three months and if the trial is not concluded within the aforesaid period, the trial court shall release the petitioner on bail to his own satisfaction.
