The petitioner seeks bail in Pirpainti P.S.Case No.96 of 2016 registered for the offences under Section 341, 323, 324, 307, 504, 302, 34 of the I.P.C. and Section 27 of the Arms Act Allegation as per the F.I.R. is that on the order of the petitioner one Kesho Mandal fired on the informant causing him injury.
Submission on behalf of the petitioner is that there is no allegation of firing against the petitioner. He is in custody since 09.06.2018 having no criminal antecedent. Charge sheet has been submitted.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.53275 of 2018 (3) dt.05-10-2018 2/2 circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. XI, Bhagalpur, in Pirpainti P.S.Case No.96 of 2016 subject to the condition that one of the bailors must be of local person having sufficient properties within the jurisdiction of the court concerned.
